Terms of Service

1. Description of the Service

BodyKind is a digital wellness application that provides affirmations, guided reflections, and related tools intended to support body image, self-worth, and emotional wellbeing.

The Service may include both free and paid features.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability to you.

3. Eligibility

You must have the legal capacity to enter into a binding agreement under applicable law.

If you are under 18 years of age, you may use the Service only with the consent of a parent or legal guardian.

By using the Service, you represent and warrant that you meet these requirements.

4. Accounts and Authentication

You may use BodyKind without creating an account.

Certain features - including permanent account deletion - require signing in using Apple or Google authentication.

If you choose to authenticate:

• You are responsible for maintaining the security of your account.
• You are responsible for all activity that occurs under your account.

You may delete your account at any time within the app:

Account → Settings → Account & Backup → Delete Account

Account deletion is immediate and permanently removes your account and associated data, subject to applicable law.

5. User Content

The Service allows you to create private reflections (“User Content”).

• User Content is private and not visible to other users.
• You retain ownership of your User Content.
• You may export or share your content externally at your discretion.

By using the Service, you grant us a limited, non-exclusive, royalty-free license to store and process User Content solely for the purpose of operating, maintaining, and improving the Service.

You agree not to upload or create content that:

• Violates any applicable law
• Infringes intellectual property rights
• Is harmful, abusive, unlawful, or otherwise objectionable

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscriptions and Billing

BodyKind offers optional paid subscriptions.

All subscriptions are processed exclusively through Apple's App Store and are subject to Apple's terms, conditions, and billing policies.

By purchasing a subscription:

• You authorize Apple to charge your Apple ID account.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You may manage or cancel your subscription through your Apple ID account settings.

We do not process payments directly and do not issue refunds. Refund requests are handled solely by Apple in accordance with Apple's policies.

Your use of the Service is also subject to Apple's Standard Licensed Application End User License Agreement (EULA).

Pricing and subscription terms may change in the future.

7. Intellectual Property

All content provided by BodyKind, including but not limited to text, affirmations, designs, graphics, logos, and software, is owned by Ady Avital and protected by applicable intellectual property laws.

You are granted a limited, non-transferable, non-exclusive license to use the Service for personal, non-commercial purposes only.

You may not:

• Copy, distribute, modify, or create derivative works
• Reverse engineer or attempt to extract source code
• Use the Service for commercial purposes without prior written permission

8. Prohibited Conduct

You agree not to:

• Use the Service for unlawful purposes
• Interfere with or disrupt the Service
• Attempt to bypass subscription mechanisms
• Exploit the Service in a manner inconsistent with these Terms

9. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Ady Avital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

In no event shall total liability exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Ady Avital from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law

12. Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

The arbitration shall take place in the United States. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

If arbitration is found to be unenforceable under applicable law, disputes shall be resolved in a court of competent jurisdiction in the State of New York.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Changes to These Terms

We may update or modify these Terms at any time.

Updated Terms will be posted with a revised “Last Updated” date.

Your continued use of the Service after any changes become effective constitutes acceptance of the revised Terms.
